1. Common Elements Rules and Regulations
1.1 Common Elements Definition Common Elements of
the complex are those areas jointly owned and maintained by all unit owners,
including decks, privacy fences, and walkways to which all unit owners have an
exclusive access, and parking areas to which all unit owners have non-exclusive
use. There shall be no
obstruction of the Common Elements,
nor shall anything be stored in the Common Elements without the prior consent of
the Trustees. No use is allowed
which constitutes a fire hazard or which results in cancellation of insurance or
is a violation of the law. No use
shall increase the insurance rate for Riverview Condominium. The Common
Elements cannot be used in a manner inconsistent with the residential character
of Riverview Condominium. No
noxious or offensive use shall be made of any part of the Riverview Condominium
complex. No commercial use of
Common Elements or units themselves (for example, yard sales or similar
activities) is allowed without written consent from the Board of Trustees. Any damage caused
to Common Elements, whether intentional or unintentional, will be repaired by
the Association at the Unit Owner’s cost. 1.3
External Signs and Article Display No clothes,
sheets, blankets, laundry, television antennas, refuse, outside window covering,
or any kind of other articles shall be hung out of a Unit or otherwise placed on
any part of the Common Elements, except upon the written consent of the
Trustees. For Sale, For Rent, and
other similar signage is not allowed. Unit
Owners can temporarily display traditional seasonal and holiday decorations,
either on the outside of the buildings or affixed to windows or doors without
the consent of the Board of Trustees provided: · Decorations are displayed no more than three weeks prior to a specific holiday and removed no later than one week after the holiday. · No banners are displayed. ·
All attachments required to display decorations are removed with
the decorations. If damage occurs
from attachments, repairs will be made by the Association or the Unit Owner, at
the Unit Owner’s expense. No signs or
decorations affixed to the outside walls, doors, or windows, intended for
permanent display are allowed without prior written consent of the Board of
Trustees. Unit Owners may keep
traditional planters for flowers in front of the units.
All other items stored in front of the units require written consent from
the Board of Trustees. There shall be no
playing or lounging on any part of the Common Elements other than grass or lawn
areas or those areas to which Unit Owners have exclusive access.
The following exception applies. ·
Unit Owners, their family members, and guests, can ride bicycles,
tricycles and other similar vehicles on the paved areas.
Unit Owners are responsible for the actions of their children and guests. No barbecues or
portable cooking utensils are allowed on any part of the Common Elements, except
for on decks, if allowed by law, to which Unit Owners have an exclusive access,
or unless special permission is received in writing from the Board of Trustees. There shall be no
parking of baby carriages, playpens, child pools, etc., on any part of the
Common Elements or other than grass and lawn areas directly adjacent to a Unit
Owner’s Unit. Carriages,
playpens, child pools, etc. cannot remain on the Common Elements overnight; they
must be stored in the storage bin, or in the Unit, or on the deck.
Storage by Unit Owners in storage bins or on the decks is at the Unit
Owner’s risk. No organized
sports activities, picnicking, fires or storage of recreation times may occur on
the Common Elements without prior written approval of the Board of Trustees. Nothing
shall be altered or constructed in or removed from the Common Elements without
approval of the Board of Trustees except the following: ·
Planting of small, purely decorative plants in the
Association-installed mulch beds immediately adjacent to the Owner’s unit
(excluding vegetables, fruit plants, berry bushes, and herbs). Written
Board approval is required for anything else, including: · Installing a structure for plants, such as railroad or landscape ties, stone walls, etc. ·
Planting of trees or any shrubs. All Owner
plantings are solely the responsibility of the Unit Owner.
The Association assumes no responsibility for watering, fertilizing, or
removing plants added by Unit Owners. The
responsibility for future maintenance, on sale of a unit, must be conveyed to
the new Owner. Unit Owners can,
if they choose, install screen or storm doors at the front and back doors of the
Unit provided they conform to the accepted style (see following descriptions).
Unit Owners are responsible for installation, care, and maintenance of
these doors. 1.6.1
Front Screen and Storm Door Style All screen and storm doors installed at the front of the Units must be white in color and conform to either a Hollywood or Full-view style:

Back Screen and Storm Door Style All screen and storm doors installed at the back of the Units must be white in color and conform to the following style:

Unit Maintenance Each Unit Owner
shall be obligated to maintain and keep in good order and repair his or her own
Unit in accordance with the provisions of this Trust. Unit Owner shall
not sweep or throw, or permit to be swept or thrown therefrom, or from the doors
or windows, any dirt or other substance. No
rugs or mops may be shaken or hung from or on any of the windows or doors.
All Unit Owners are responsible for the care and replacement of their
Unit’s window panes, storm windows, window mullions (that is, the wooden
window inserts) and screens. Repairs
are to be completed within 15 days. Any Unit Owner
that does not comply with this rule will receive notification from the Board of
Trustees, or their agents. If no
response is made to the notification after 15 days, the Association will take
the necessary action at the Unit Owner’s expense. All maintenance
and repair personnel are required to be properly insured while performing any
tasks on the premises. Unit Owners
are responsible for ensuring that only properly insured personnel perform any
work in their units. 1.9
Electrical Equipment Usage All radio,
television or other electrical equipment of any kind or nature installed or used
in each Unit shall fully comply with all rules, regulations, requirements or
recommendations of the Board of Fire Underwriters and the public authorities
having jurisdiction, and the Unit Owner alone shall be liable for any damage or
injury caused by any radio, television or other electric equipment in such Unit
to any other Unit or to the Common Elements. 1.10
Power Tool Usage Power tools may not be operated in Units except during the hours of 8 a.m. to 8 p.m., or in the case of an emergency. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
